Heidi Makes Third Round of Rogue’s Gallery

After her earlier nomination and being a part of The Dirty Dozen of 2010, Heidi has been inducted into the Third Class of the Rogue’s Gallery!

The Rogues Gallery was designed to hold people like Heidi Diaz.  She had no problem being the first person to snuggle up to the otherwise reviled Kevin Trudeau.  She duped people out of money, she lied about a diet that was found to be unhealthy and has since modified the diet and continues to try to sell it.  She asked people to send her cheques when the court ordered her Paypal account money because she claimed that was the only money she had.  She lied so often and so poorly it is amazing that she is not sitting in jail.  You can read about the whole thing here.  She is an unrepentant con woman who continues to operate her website, but now she has finally added the court ordered warning to her page.  It is in the barely visible colour of off-white on a white background.

Seriously, her own webpage says she has engaged in false advertising fraudulent business practices.  At this point if you are stupid enough to fall for her pile of lies you really are on your own…

The Dirty Dozen of 2010

Congratulations, Kimmer!  Another dubious honor for Heidi Diaz and Kimkins is being #5 in The Dirty Dozen of 2010.  And this time, she is not alone!  Coming in at #8 is Women’s World Magazine  and Bauer Publishing!

Women’s World Magazine deserves an extra helping of shame by the way.  After being a catalyst in the success of the Kimkinz diet (#5 above), they offered an apology for their extraordinary cover claims.  They say that your trust means everything to them, but they still advertised the Kimkinz diet, a diet based upon less than 500 calories a day as ‘better than gastric bypass’.  It is really hard to read those 2 thoughts in one sentence.  Again, all of this was in 2007, so why Women’s World Magazine in 2010?

Even after apologizing for what was clearly non-existent reporting work and extreme hyperbole, Women’s World Magazine has continued to report on diets with the same style, shouting out extraordinary successes as if they are routine and even guaranteed.  This year we had the ‘lose 11 pounds a week on Dr. Oz’s easy detox diet’, ’0.85$ miracle breakfast will MELT OFF 40 LBS!’, and ‘THE JUICE THAT MELTS BELLY FAT-drink 2 glasses a day -and lose 9 lbs and 3″ in a week!’. These claims are crap.  Inside you will see some sensible diet advice coupled with one individual story of a person’s extreme weightloss.  This wouldn’t pass muster with the FTC in terms of diet claims, but because they are selling magazines, and indirectly selling the fad diet, they get away with it, and this isn’t even looking at the other insane claims they make on their covers nor the diet advice coupled with the pictures of cupcakes and desserts that seem to coexist, on the cover at least.

In her deposition she admitted to lying and falsifying claims for the diet.

Skip ahead to the end of the trial, which was recent, 3 years after these people started to go after the Kimmer and the court finds that Heidi Diaz is a liar and a fraud.  She has ripped off members for 1.8 million dollars (at least, she plays so stupid in court it is infuriating) and  on top of the 1.8 million dollar award, the court adds an unprecedented  $500,000 in punitive damages.  You can read the transcript here and if you want to see what the worst of the worst humans are like, you should read this.

If all of this is not enough to put Heidi in the Rogues Gallery, there are claims that Heidi Diaz also collected money for foster kids that don’t exist (these could be connected to the false job she claimed she had helping foster kids).

To all Ducks

Today, October 29, 2010, Judge Rick Brown of the Riverside County Superior Court entered a verdict for the plaintiffs in a certified national class action lawsuit. The court entered a verdict against Heidi Diaz the owner of the diet website Kimkins.com for fraud and false advertising. The court awarded the class members restitution in the amount of $1,824,210.39. The court also awarded an additional $500,000 in punitive damages as well as attorney fees. The court then issued a temporary restraining order to freeze all of the assets of Ms. Diaz.

Most notably, the court also imposed an injunction requiring Heidi Diaz to post on all of her websites that: (1) she lied about her weight loss; (2) she lied about her after diet pictures; (3) she lied about testimonials on her website; and (4) she lied about the photographs used with the testimonials to promote the Kimkins website.

An injunction was also issued to prevent Heidi Diaz from contacting, harassing or cyberbulling the plaintiffs and the witnesses. A formal judgment will be entered before November 19, 2010.

The original complaint was filed over three years ago on October 15, 2007. I want to thank everyone who supported the class action lawsuit. The Ducks were wonderful. I met a lot of great people and made a lot of new friends fighting for a good cause. Heidi Diaz lied on her website and made the fatal mistake of lying in the courtroom. You cannot trust Heidi Diaz. I anticipate more legal (illegal) maneuvering by Heidi Diaz to evade the judgment. We will be prepared and I will be relentless. Again, I thank all you.

I just wanted to say one last “Thank You” to Tom Roddy, from LowCarbFriends.com and Netrition.com.  Tom had been very helpful while working with us all in our endeavors to prevent Heidi Diaz from continuing to perpetuate her dangerous Kimkins Diet Scam.  Tom was even one of those named in Heidi’s countersuit.

I’ve been able to thank Tom, many times over, for all his help, but that certainly doesn’t prevent the sadness that comes from knowing he is gone.  We have lost a very dear friend in Tom.

My thoughts and prayers go out to his family and friends.

Tom Roddy, you will be greatly missed.  Rest In Peace.
